Malta Cookie Consent Requirements

In August, the Office of the Information and Data Protection Commissioner (IDPC) published a brief guidance on cookie consent requirements in Malta, aiming to assist operators making use of cookies in online services.

 

In particular, the guidance defines cookies and highlights that, in accordance with the applicable legal framework, operators of online services need to implement a valid consent mechanism to enable data subjects to provide an affirmative action indicating their willingness to receive tracking cookies.

 

Additionally, the guidance outlines the relevant regulations within the Processing of Personal Data Regulations, which transposed the ePrivacy Directive, exempting certain cookies from the consent requirement.

 

Finally, the guidance provides a non-exhaustive list of practices which are not in compliance with data protection rules, including cookie walls, pre-ticked boxes, and scrolling, with accompanying examples on each practice.
