What is a Cookie Notice?

Cookie Notice

A Cookie Notice is a document that outlines the types and use of cookies on a website. It’s also known as a cookie policy or cookie consent notice. You can find a cookie notice on a separate page of a website or a sub-section of a privacy policy that is dedicated just to cookies.

This is not to be confused with a Privacy Policy Notice, which is the document that a website owner uses to outline the methods and purposes of its data processing to users. Additionally, a cookie banner is a pop-up that appears when a user first visits a website. It informs a user that their data is being collected and will be used for certain purposes. A cookie consent banner will give the user an opportunity to consent to their data being processed.

 

Do I Need a Cookie Consent Notice?

A cookie consent notice is required if you collect data from European Union visitors as expressed in the GDPR and ePrivacy Directive. You can’t control who visits your website. Therefore, it’s highly encouraged to have some kind of cookie consent notice on your website. This is especially true if you use tracking technologies like Google Analytics, HubSpot, plugins, and social media buttons.

Requirements for GDPR & CCPA Compliance

European law states websites that track users’ personal data and don’t comply with cookie consent notices or banners will face heavy fines and penalties. Some violations are subject to up to 4% of the organization’s global annual turnover.

A compliant cookie consent notice must:

  • acquire clear and unambiguous consent
  • collect consent before processing a user’s data
  • document all records of collected consents
  • specify all the types of cookies and tracking technology it uses
  • not include pre-ticked checkboxes
  • enable users to revoke consent on each category of cookies
  • renew consent annually

The CCPA applies to businesses, that meet one more of the following criteria. Defined as for-profit organizations that collect personal information about residents in California. Businesses that determine the purpose and means of the processing and does business in the State of California.
