What is Implied Consent?

Last Updated: March 18, 2020

Implied consent is a cookie consent model that assumes the user has consented from their individual actions, not with verbal or written consent. The site will already have cookies or other tracking technologies in place by default upon arrival, and it is up to the user to turn those off. The passive action means that many users aren't aware of what information is being collected or even what they've consented to just by loading the site. As a best practice, moving toward an opt-in consent model helps website owners comply with global privacy regulations. This is the best option to be transparent with users, gain trust, and ultimately avoid penalties.
