As version 2 of the Interactive Advertising Bureau’s (IAB) Transparency and Consent Framework (TCF), IAB TCF 2.0, draws near, it’s important for publishers and ad tech companies to take steps towards compliance.
How does the TCF work?
The Framework consists of open-source technical specifications managed by the IAB Tech Lab, and policies managed by IAB Europe. It has been designed to standardize the provision of notice about personal data processing, and the transmission of signals about user choices and transparency related to data processing, so that the digital advertising supply chain can continue to function in a way that aligns with GDPR requirements
The Framework facilitates providing transparency and obtaining consent and makes this information available across the digital advertising supply chain.
What is IAB TCF 2.0?
IAB TCF v2 is a revamped version of the original framework (IAB TCF v1). The purpose is to standardize how businesses – publishers, ad-tech vendors, agencies, and advertisers – can continue to run programmatic advertising in a way that’s compliant with GDPR. This includes how they request, store, and share user consent along the supply chain. The IAB’s position is that the TCF will get everyone on the same page as to what compliance looks like.
According to the IAB, the TCF’s objective is to help all parties in the digital advertising chain ensure they comply with the EU’s GDPR and ePrivacy Directive when processing personal data or accessing and/or storing information on a user’s device such as cookies, advertising identifiers, device identifiers, and other tracking technologies.
The TCF creates an environment where website publishers can (1) tell visitors what data is being collected and (2) how their website and the companies they partner with intend to use it. The TCF gives the publishing and advertising industries a common language with which to communicate consumer consent for the delivery of relevant online advertising and content.
What are the Goals of IAB TCF 2.0?
The goal of the Framework is to help players in the online ecosystem meet certain requirements of the ePrivacy Directive (and by extension its successor, the upcoming ePrivacy Regulation), and the General Data Protection Regulation by providing a way of informing users about the storing and/or accessing of information on their devices, the fact that their personal data is processed, the purposes for which their personal data is processed, the companies that are seeking to process their personal data for these purposes, providing users with a choice about the same, and signaling to third parties which information has been disclosed to users and what users’ choices are.
Why was it Revamped?
The first version was considered too biased towards ad-tech vendors and not understanding what would be beneficial for publishers. The new version is more geared towards publishers’ needs.
They key changes are:
- More transparency & control for consumers
- Greater control for publishers
- Enhanced support of the GDPR’s “legitimate interests” legal basis for processing personal data
Summary
The original release of the framework (IAB TCF 1.1) was the first of its kind, intended to standardize the way companies delivering targeted ads comply with GDPR. The updates to the Framework include expanded specifications with publishers, consent management providers, and advertisers in mind.
The updated Framework includes tools for ensuring compliance with the GDPR through updated guidance for consent, the right to object, and the right to withdraw consent. Consumers have greater control over what data is collected on them and what is done with it, and publishers have a standardized way to comply with the ePrivacy Directive and GDPR.
