On June 10, 2021, the Italian data protection authority, also known as the ‘Garante’, released finalized guidance on cookies and other tracking technologies (the Guidelines). Seven months ago, the Garante released a draft version for public consultation. These guidelines have confirmed that website owners have six months to comply.

Italy Cookies Guidelines Overview

Following with the GDPR, the Guidelines aim to emphasize the legislation applicable to the storing of information, or gaining of access to information already stored, in the terminal equipment of users, as well as to specify the lawful means to provide the cookie policy and collect online consent of data subjects. Additionally, due to recent technological developments and regulatory updates, the Guidelines state that the Garante’s previous guidance on Simplified Arrangements to Provide Information and Obtain Consent Regarding Cookies, while maintaining its relevance, needed to be integrated with specific reference.

Key highlights from the finalized guidelines include:

  • Legitimate interest is not considered a lawful ground to set cookies and similar tracking technologies;
  • Ability to re-present a cookie banner to a user after six months from the initial presentations;
  • Place an ‘X’ button on the cookie banner so users can continue navigating without consenting to the use of non-technical cookies;
  • Authenticated users must have the ability to consent to the possibility of being tracked by cross-analysis of their behavior through the use of different devices;
  • If there are changes to the third parties list, the website owner is responsible for the selection of the same third parties and must ensure that the resulting processing remain in line with the category groups;
  • New specifications for the accessibility of cookie information in relation to persons with disabilities;
  • Information on the criteria for cookie categorization may be included in the privacy policy or to the dedicated cookie policy.
  • Include a link for the user to update their cookie preferences at any time in the website’s footer;
  • On any domain, include a graphic sign, an icon, or technical features to illustrate the status of the user’s expressed consents, and allow changes.
